The materials for sale are intended for laboratory
and research use only. They are NOT for use as food additives, drugs, cosmetic,
household chemicals, or other inappropriate applications or for resale. THE BUYER WARRANTS THAT HE/SHE IS AT LEAST18
YEARS OF AGE. It is agreed that all of
the products will be handled only by qualified and trained individuals. In
purchasing these products, the buyer acknowledges that there are hazards
associated with their use which have not been determined through research or
use and assumes all risks associated with the use of the products. Buyer
represents and warrants to the vendor, it’s agents and assigns that from buyers
own independent review and study they are fully aware and knowledgeable about
(I) the health and safety hazards associated with the handling of the products
purchased; (II) industrial hygiene controls necessary to protect themselves and
others from such health and safety hazards; (III) the need to adequately warn
of health and safety hazards associated with products; and (IV) all government
regulations at all levels of government regarding the use of and exposure to
such products in the jurisdiction where the buyer will possess and use the
product. Buyer acknowledges that the products have not been tested by supplier
for safety and efficacy in food, drug, and medical device, cosmetic, commercial
or any other use
We reserve the right
to limit sales of products or not to sell products to unqualified customers
however by agreeing to these terms and conditions the customer warrants to the
vendor that the customer is appropriately qualified in any and all respects.
IN NO EVENT SHALL MELANOTAN
US INC. OR ANY OF IT'S EMPLOYEES, OFFICERS DIRECTORS, AGENTS OR ASSIGNS BE
LIABLE FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER THE BUYER’S
CLAIM IS IN CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE. IN CONSIDERATION
OF THE SALE OF PRODUCT TO BUYER, WHICH SALES WE WOULD NOT OTHERWISE MAKE BUT
FOR THE BUYER AGREEING TO ALL OF THESE TERMS AND CONDITIONS, PURCHASER AGREES
TO INDEMNIFY AND HOLD MELANOTAN US INC. AND ITS OFFICERS, DIRECTORS, AGENTS AND
ASSIGNS HARMLESS FROM ALL CLAIMS, EXPENSES, LOSSES AND LIABILITY OF ANY NATURE
HOWSOEVER ARISING OUT OF BUYER'S HANDLING AND/OR USE OF PRODUCT, WHETHER USED
ALONE OR IN COMBINATION WITH ANY OTHER SUBSTANCE.
IT IS A TERM OF EACH
SALE AND EACH USE OF THE PRODUCT, INCLUDING ANY UNINTENDED OR ACCIDENTAL USE THAT THE PURCHASER RELEASES
AND HOLDS HARMLESS MELANOTAN US INC, IT’S OFFICERS DIRECTORS, AGENTS,
EMPLOYEES, SHAREHOLDERS AND ASSIGNS, FOR ANY AND ALL DAMAGES CAUSED EITHER
DIRECTLY OR INDIRECTLY FROM MUCH US OR MISUSE WHETHER OR NOT MELANOTANUS INC.
HAS BREACHED ITS CONTRACT WITH THE PURCHASER OR HAS BEEN NEGLIGENT OR GROSSLY
NEGLIGENT IN ANY WAY.
This is a legally binding document and by agreeing you agree to any and all
terms contained in this document.
